Terms and Conditions for Wayt Digital Pager App

1. Introduction
Welcome to Wayt, a digital pager app designed to streamline customer waitlists, orders, and notifications. By using our app ("Wayt," "the App," or "Service"), you agree to comply with and be bound by these Terms and Conditions ("Terms"). Please read these Terms carefully before using the App. If you do not agree with these Terms, you must not use the Service.

2. Eligibility
To use Wayt, you must be at least 18 years old or the age of majority in your jurisdiction. By using the App, you confirm that you meet these age requirements and are legally capable of entering into these Terms.

3. Account Registration
To access certain features of Wayt, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update this information as needed. You are responsible for maintaining the confidentiality of your account login credentials and for all activities under your account.

4. Service Description
Wayt allows businesses to manage customer waitlists, orders, and notifications digitally, replacing traditional pagers. The Service includes, but is not limited to, creating and managing customer waitlists, sending text messages to customers, and tracking order status.

5. Use of the Service
You agree to use Wayt only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that may:

Violate any applicable laws or regulations.
Infringe the intellectual property rights of others.
Disrupt, damage, or interfere with the functioning of the App or the experience of other users.
Engage in fraudulent activity or misrepresent your identity.

6. Subscription Plans
Wayt offers both a free and premium subscription plan. By subscribing to a premium plan, you agree to pay the applicable fees, as outlined during the sign-up process. Subscription fees are billed on a monthly or annual basis, as specified, and are non-refundable, except where required by law.

7. Trial Period
Wayt offers a 14-day free trial of the premium plan, which provides full access to premium features. After the trial period ends, you will be automatically moved to the free plan unless you opt to continue with a paid subscription.

8. Payment and Billing
Payments for premium subscriptions are processed through third-party payment providers. You agree to provide accurate billing information and authorize the payment provider to charge your payment method according to the terms of your subscription. Any issues related to billing should be directed to Wayt’s support team.

9. Privacy and Data Collection
Your use of Wayt is governed by our Privacy Policy, which details the information we collect, how we use it, and how we protect your privacy. By using the App, you consent to the collection and use of your data in accordance with our Privacy Policy.

10. Content and User-Generated Material
You retain ownership of any content you submit or upload through Wayt. However, by submitting content, you grant Wayt a license to use, display, and distribute such content solely for the purpose of providing the Service. You agree not to upload or share content that is illegal, harmful, or infringes the rights of others.

11. Limitation of Liability
Wayt provides the Service "as is" and does not warrant that the Service will be error-free or uninterrupted. We are not liable for any damages, including direct, indirect, incidental, or consequential damages, arising from your use of the App or from any interruption in Service.

12. Termination
We reserve the right to suspend or terminate your access to Wayt at any time, with or without notice, if you violate these Terms or engage in activity that may harm the Service or other users.

13. Modifications to the Service
Wayt reserves the right to modify, update, or discontinue any feature or aspect of the App at any time. We will notify users of any significant changes, but it is your responsibility to stay informed of updates.

14. Indemnity
You agree to indemnify and hold harmless Wayt, its employees, affiliates, and partners from any claims, losses, or damages, including legal fees, arising out of your use of the Service or violation of these Terms.
